The Legal Protection for Personal Data in The E-Litigation Era
Abstract
- Praise be to Allah, Lord of all worlds, and peace and blessings be upon the most honorable of all creation, our prophet Muhammad, may Allah's peace and blessings be upon him. Thereafter: because of technological development who invades the whole world, and all scientific and practical fields, including the legal and judicial fields.
As a result of compulsion individuals by judge to provide a lot of personal information’s as evidence and documents without their consent sometimes. From the initial filing of the electronic lawsuit until its final adjudication, Such as personal data, case-related documents, and the defendant's personal information, among other things. Digitalizing this data and making it apart from the government database, is at risk of being hacked one day. There for it must be a type of legal protection on this data. Because one of the fundamental human rights is the right to protect personal data and protect him from using it illegally.
The significance of this research paper is the existence of comparative study between varying countries’ laws. Especially Egypt, Saudi Arabia, and UAE, in the field of personal data protection, and the penalties imposed for cybercrimes. Especially due to technological progress, and most countries have adopted e-litigation.
The research problem revolves around the recency of e-litigation, also the data obtained from it, and how to protect this data due to technological progress. Additionally, the legislation is not keeping pace with these developments at the required speed. Consequently, there is a lack of research and publications in this domain.
I employed a descriptive- analytical approach for varying countries’ laws, in the field of information security and e-litigation.
Additionally, the research paper structure can be divided into two sections, first I will discuss e-litigation. Second, I will discuss the legal guarantees required to protect individuals’ personal data.
