The Legal and Political Framework of Governance In Post-2021 Afghanistan: Challenges and Perspectives

Abstract
This paper delves into the significant transformations within Afghanistan’s legal and political framework following the Taliban’s return to power in August 2021. This period marked a shift from the previous democratic system based on the 2004 constitution to a theocratic governance model centered around sharia law. The discussion addresses the implications for human rights, internal and external legitimacy, and international relations. By applying political science and legal theory, this paper also considers prospective governance scenarios for Afghanistan within its regional and global context.
