The 2017 Treaty on the Prohibition of Nuclear Weapons and Customary International Law

Abstract
The Treaty on the Prohibition of Nuclear Weapons from 2017 is the first universal international instrument that prescribes the prohibition of nuclear weapons and as such represents a major contribution to international law in the field of nuclear disarmament. The states that are parties to the Treaty belong to the group of non-nuclear states, and in relation to them, compliance with the rules and fulfillment of the obligations prescribed by the Treaty should not pose any problem. However, it is the major nuclear powers that have questioned the practical effect of the Treaty as they see the Treaty as an unrealistic and progressive approach to disarmament. Therefore, in the context of the Treaty, the question will be answered whether the nuclear states can prevent the possible establishment of customary international law according to the persistent objector rule.
