Unworthy Heirs under Thai Succession Law: The Case of Parents who Failed to Meet Rethinking Legal Responsibility to their Children
Abstract
These article called Rethinking Unworthy Heirs under Thai Succession Law: the case of parents who failed to meet Legal Responsibility to their Children aimed to state the problem lie in Thai Succession Law relevant to cancellation of right to inherit for parents. There is a cultural norm of showing reverence to one's elders in Thai society. Therefore, parents never lose the right to inherit as an heir regardless of how their children may behave in the future. On the other hand, in certain countries like Austria and the Philippines, the behavior of the heirs—specifically, whether or not they are successful in performing their legal responsibility to the inheritor—is the determining factor in whether or not they are allowed to exercise their right. In addition to Croatia, there is a condition that is established in the regulation that states that descendants will lose their ability to inherit if they commit an act of indignity against the inheritor. On the other hand, based on traditional reasons, such a condition is not very likely to be implemented in Thai Succession Law.
