Legal Measures for Reducing the Risk and Disaster Prevention and Mitigation under the Disaster Prevention and Mitigation Act, 2007

Abstract
Few years ago, Thailand has faced many forms of catastrophes and disasters whether it is a national disaster such as floods, flash floods, mudslides and landslides, and tsunamis or human-caused natural disasters, such as fire, ship sink, lost in the forest or cave because such person entered into the forbidden area without having the permission of the responsible agency. As the country grows up, catastrophes and disasters are intensifying and affecting the physical, economic, and society, and it increases more and more loss of natural resources. However, the law related to the disaster mitigation still has defects. For example, there are no coverage legal measures on disasters and prevention mitigation in academic way. There is also no legal measure to remedy the damage, no measures to penalize people who have contributed or caused the disaster, and no measures to prevent the repeated offenses if such catastrophes or disasters caused by human. This research aims to improve and develop the law to establish rules and measures regarding the scope catastrophes and disasters, risk reduction guideline, and mitigation and remedy for the occurred disasters.
