The Legal Basis of Countries Liability for The Environmental Damages Arising From Disposal of The Nuclear Wastes

Abstract
This paper aims at addressing the legal basis for the international liability for environmental damage resulting from the disposal of nuclear waste in accordance with the draft articles of the International Law Commission, which concluded that the responsibility of the State for such damages is not only for violating its international obligations of safe disposal of nuclear waste, Protecting human health, but also the responsibility of the State, even though it does not violate any international obligation to implement the risk liability theory, in order to ensure fair and prompt compensation to the affectedd states.
